Welcome to 9Team.dev. By accessing or using our service, you agree to be bound by these Terms of Service.

1. Service Description

9Team.dev provides an AI-powered platform that helps users build full-stack applications through natural language descriptions. The service includes:

• AI-powered application generation
• Code download and export capabilities
• Preview and testing environments
• Optional subscription plans for enhanced features

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

Age requirement: You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to create an account. Users under the age of majority must have a parent or guardian accept these Terms on their behalf. We do not knowingly collect data from children under 13; accounts identified as belonging to a child under 13 will be deleted.

3. Subscription Plans

Free Plan: Includes 60 credits for up to 60,000 hosted-AI tokens. No credit card required.

BYOK Plan ($5/month): Access to all 10 AI agents. You provide your own OpenAI/Claude API key. You are responsible for API costs charged by the providers.

Pro Plan ($20/month): 1,000 credits (up to 1 million tokens) per month, AI hosting included. Credits refresh monthly and do not roll over.

4. Payment Terms

• Subscriptions are billed monthly in advance
• All fees are non-refundable except as stated in our Refund Policy
• We use Stripe for payment processing
• Prices are subject to change with 30 days notice
• Failed payments may result in service suspension

5. Credits System

• Hosted-AI builds use approximately 1 credit per 1,000 tokens
• Build cost varies with actual token usage
• Unused Pro credits roll over up to twice the monthly allocation
• Credits are non-transferable and have no cash value
• Builds that produce no files are not charged

6. User Content and Intellectual Property

Your Content. You retain all right, title, and interest in the prompts, project descriptions, images, and other materials you submit ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to store, process, and transmit Your Content solely to operate the service and to improve it in aggregated, de-identified form.

Generated Output. Subject to your compliance with these Terms, we assign to you all rights we may have in the code, designs, text, and other outputs produced by our AI agents in response to Your Content ("Output"). You are free to use, modify, distribute, sublicense, and commercialize the Output for any lawful purpose.

Warnings about AI Output. AI-generated Output may (a) resemble content produced by third parties, (b) contain security or licensing defects, and (c) be non-copyrightable in some jurisdictions if generated without sufficient human authorship. You are solely responsible for reviewing the Output for correctness, licensing, security, and infringement before using it in production. We disclaim any warranty that the Output is original, non-infringing, or fit for a particular purpose.

Our Platform. The 9Team platform, brand, name, logos, agent system, prompts library, and website are our exclusive property or licensed to us. Nothing in these Terms transfers any rights in the platform to you.

Feedback. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

6a. DMCA / Copyright Complaints

We respond to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (17 U.S.C. §512) and comparable laws in other jurisdictions. If you believe content on the service infringes your copyright, send a written notice to our Designated Agent that includes:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the material you claim is infringing and where it is located on the service (URLs)
• Your contact information (address, phone, email)
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act

Counter-notices may be sent to the same address and will follow the process in §512(g). We will terminate the accounts of repeat infringers in appropriate circumstances.

7. API Keys and Third-Party Services

For BYOK plans:

• You are responsible for obtaining and maintaining your own API keys
• API costs are billed directly by providers (OpenAI, Anthropic)
• We encrypt stored keys but recommend rotating them regularly
• We are not responsible for provider rate limits or API changes

8. Acceptable Use Policy

You agree NOT to:

• Generate malicious, illegal, or harmful content
• Violate intellectual property rights of others
• Attempt to reverse engineer or abuse our service
• Create excessive load through automated scripts
• Share accounts or resell access to our service
• Use the service for spam or phishing

9. Service Availability

• We strive for 99% uptime but do not guarantee it
• Scheduled maintenance will be announced in advance
• We are not liable for downtime or service interruptions
• AI providers (OpenAI, Anthropic) may have their own outages

10. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "AS IS" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the last 12 months
• Generated code is provided without warranty of fitness
• You are responsible for testing and validating all code

11. Termination

Either party may terminate at any time:

• You may cancel your subscription from your account settings
• We may suspend/terminate accounts for Terms violations
• Upon termination, you lose access to builds and credits
• Downloaded projects remain yours to use

12. Changes to Terms

We may update these Terms with notice:

• Material changes require 30 days notice
• Continued use constitutes acceptance
• You may terminate if you disagree with changes

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute arising from or relating to the service shall first be attempted to be resolved informally by contacting legal@9team.dev. If not resolved within 30 days, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Wilmington, Delaware. You waive the right to a jury trial and to participate in class actions. Nothing in this section prevents either party from seeking equitable relief for infringement of intellectual property rights. If you reside in the European Union, United Kingdom, or a jurisdiction whose consumer-protection laws forbid such an arbitration clause, this section does not apply to you and you retain your statutory rights.
